Administrative Decisions

AP 17-08: Christopher and Tiffany Jones, owners of 5273 Refiled Road, request a Special Administrative Permit per Chapter 27, Section 27-436(4) to encroach the rear yard setback by up to 10% for construction of a home addition. The tax parcel number is 18 377 01 070.

September 7, 2017 Zoning Board of Appeals Meeting

ZBA 17-10:  JWC Loden, LLC, owner of 1891 Point Place Avenue, seeks a variance from Chapter 27, Section 27-267 to permit a 6-foot tall fence in a street yard. The Tax Parcel ID is 18 345 01 371.

Decision: The board voted to grant the variance with conditions (7-0).

 

ZBA 17-12:  Richard Griffeth, owner of 4860 Adams Road, seeks a variance from Chapter 27, Section 27-147(2), to divide the property and construct a new single-family home. The Tax Parcel ID is 18 360 01 041.

Decision: The board voted to grant the variance with conditions (7-0).

 

ZBA 17-13:   Jessica Hill, attorney for the applicant, on behalf of Trammell Crow Company, applicant, and Perimeter Mall LLC, owner of 1134 Hammond Road, Dunwoody, GA 30346 (Tax Parcel ID: 18 348 01 020; “Development Parcel”) and 4400 Ashford Dunwoody Road, Dunwoody, GA 30346 (Tax Parcel ID: 18 348 01 006; “Mall Parcel”), seeks the following variances from Chapter 27, Section 27-73:

1.)  To encroach the front yard setback for the construction of a twenty story office building. and existing 600-car parking garage (Development Parcel);

2.)  To encroach the front yard setback for the construction of an existing 619-car parking garage (Development Parcel);

3.)  To encroach into the rear yard setback for the construction of a sixteen story building (Development Parcel);

4.)  to encroach in the interior side yard setback for the construction of a ten story hotel (Development Parcel);

5.)  to encroach into the side yard setback for the construction of a ten story hotel (Development Parcel);

Prado Perimeter Center, LLC owner of 121 Perimeter Center West (Tax Parcel ID: 18 349 05 029) by Dennis J. Webb, Jr., attorney for the owner, seeks the following:

-    SE 17-01:  Special Exception per Chapter 27, Sec. 27-416 to reduce the required parking from 457 to 378.

-    ZBA 17-14:  Variance from Chapter 27, Sec. 27-73 to (A) reduce rear setback from 40 feet to 10 feet; and (B) Variance to reduce side setback from 20 feet to 10 feet.

Decision: The board voted to grant the variances with conditions (7-0).

 

ZBA 17-15:  Adam Schneider, owner of 1398 Wickenby Court, seeks a variance from Chapter 16, Section 16-78, to encroach the 75-foot stream buffer for construction of a retaining wall. The Tax Parcel ID is 18 363 02 033.

Decision: The board voted to grant the variance with conditions (7-0).

 

September 12, 2017 Planning Commission Meeting

Dennis J. Webb, Jr., attorney for the applicant, Prado Perimeter Center, LLC, owner of 121 Perimeter Center West, Dunwoody, GA 30346 (tax parcel ID 18 349 05 029), seeks the following:

October 5, 2017 Zoning Board of Appeals Meeting

ZBA 17-09Marcus and Brianne Scott, owners of 1706 North Springs Drive, seek a variance from Chapter 27, Section 27-267 to permit a fence in the front yard at a height greater than allowed by right. The Tax Parcel ID is 18 352 06 009.

October 9, 2017 City Council Meeting

Review and consideration of a text amendment to the Tree Ordinance (Chapter 16, Division 6)

Decision: City Council voted to approve with conditions (7-0).

 

SLUP 17-03: Jessica Hill of MMM Law, Attorney for Trammell Crow Company, the applicant for a portion of 1134 Hammond Road and 4400 Ashford Dunwoody Drive (Tax Parcel ID 18 348 01 020 and 18 348 01 006), Dunwoody, GA 30346, seeks a Special Land Use Permit per Chapter 27, Section 27-73(b) to increase the building height in a C-1 (Local Commercial) District from 2 Stories/35 Feet to a 16 Story Office Building and 10 Story Hotel.

Decision: City Council voted to approve with conditions (5-2).

 

October 10, 2017 Planning Commission Meeting

SLUP 17-04: Special Land Use Permit per Chapter 27, Section 27-73(b) to increase the building height in a OCR District from 2 stories/35 a seven story or 83 feet tall hotel and a five story parking structure.

Decision: The commisssion voted to recommend approval with conditions (5-2).

 

November 2, 2017 Zoning Board of Appeals Meeting

ZBA 17-19Robert D. Schreiner and Patricia M. Simone, owners of 1159 Oak Trail Court, seek a variance from Chapter 27, Section 27-58 Section 27-58, to encroach the rear yard setback for construction of a new, screened porch. The Tax Parcel ID is 18 364 06 050.

Decision: The board voted to grant the variance with conditions (5-0).
