Administrative Decisions

AP 17-07: Andrew Halloran, on behalf of All Saints Catholic Church. owner of 2443 Mount Vernon Road, Dunwoody, GA 30338, requests a Special Administrative Permit per Chapter 16, Section 16-79(b)(5) to allow the construction of a storm pipe in the city stream buffer to protect the buffer from erosion caused by high-flow velocities due to steep slopes. The tax parcel number is 18 373 02 003.

Decision: Approved with conditions - August 7, 2017.

June 20, 2017 Planning Commission Meeting

Review and consideration of Sign Ordinance text amendments (Chapter 20).

Decision: The Commission recommended approval of the ammendment with conditions (6-0).

 

July 11, 2017 Planning Commission Meeting

MA 17-01: RB 84 PC, LLC, owner of 84, 130, and 140 Perimeter Center East, by Laurel David, attorney for the owner, seeks to modify preivous zoning conditions. The tax parcel numbers are tax parcel number 18 347 01 013,021, and 028.

Decision: The Commission recommended approval of the ammendment with conditions (6-0).

 

July 13, 2017 Zoning Board of Appeals Meeting

ZBA 17-03: Patrick Dodson, owner of 5245 Mt. Vernon Way, seeks a variance to Chapter 27, Section 27-58, to encroach the rear yard setback to permit an existing playset. The tax parcel number is 18 375 02 025.

Decision: The board voted to deny the variance (7-0).

 

ZBA 17-06:  Diego Fracasso, on behalf of Kristi Halford, owner of 1394 Valley View Road, seeks a variance to Chapter 16, Section 16-78, to encroach the City’s 75-foot stream buffer for renovation of a porch and deck. The tax parcel number is 18 363 07 051.

Decision: The board voted to grant the variance with conditions (7-0).

 

ZBA 17-07:  Leslie Jessee, owner of 5381 Oxford Chase Way, seeks a variance to Chapter 27, Section 27-58, to encroach the side yard setback for a home addition. The tax parcel number is 18 373 01 118.

July 24, 2017 Mayor and City Council Meeting

Ordinance Amendment to Chapter 20 - Signs.

Decision: City Council voted to approve with conditions (7-0).

 

August 3, 2017 Zoning Board of Appeals Meeting

ZBA 17-08Brogdon Consulting, on behalf of Peachtree Shops of Dunwoody, LLC, owner of 5486 Chamblee Dunwoody Road, seeks a variance from Chapter 27, Section 27-131(b)(1), to encroach the 100-foot setback for animal care from a residentially zoned lot. The tax parcel number is 18 366 01 001.

August 8, 2017 Planning Commission Meeting

Review and consideration of a text ammendment to the Tree Ordinance (Chapter 16, Division 6).

Decision: The Commission recommended approval of the ammendment (4-0).

 

Jessica Hill of MMMlaw, attorney for Trammell Crow Company, the applicant for a portion of 1134 Hammond Road (tax parcel ID 18 348 01 020) and 4400 Ashford Dunwoody Drive, Dunwoody, GA 30346 (tax parcel ID 18 348 01 006), seeks the following:

SLUP 17-03: Special Land Use Permit per Chapter 27, Section 27-73(b) to increase the building height in a C-1 (Local Commercial) District from 2 stories/35 feet to a 16-story office building and 10-story hotel.

Decision: The Commission recommended approval of the request with conditions (3-1).

 

September 7, 2017 Zoning Board of Appeals Meeting

ZBA 17-12:  Richard Griffeth, owner of 4860 Adams Road, seeks a variance from Chapter 27, Section 27-147(2), to divide the property and construct a new single-family home. The Tax Parcel ID is 18 360 01 041.

ZBA 17-13:   Jessica Hill, attorney for the applicant, on behalf of Trammell Crow Company, applicant, and Perimeter Mall LLC, owner of 1134 Hammond Road, Dunwoody, GA 30346 (Tax Parcel ID: 18 348 01 020; “Development Parcel”) and 4400 Ashford Dunwoody Road, Dunwoody, GA 30346 (Tax Parcel ID: 18 348 01 006; “Mall Parcel”), seeks the following variances from Chapter 27, Section 27-73:

1.)  To encroach the front yard setback for the construction of a twenty story office building. and existing 600-car parking garage (Development Parcel);

2.)  To encroach the front yard setback for the construction of an existing 619-car parking garage (Development Parcel);

3.)  To encroach into the rear yard setback for the construction of a sixteen story building (Development Parcel);

4.)  to encroach in the interior side yard setback for the construction of a ten story hotel (Development Parcel);

5.)  to encroach into the side yard setback for the construction of a ten story hotel (Development Parcel);

6.)    to encroach in the interior side yard setback for an existing 619-car parking garage (Development Parcel); and

Prado Perimeter Center, LLC owner of 121 Perimeter Center West (Tax Parcel ID: 18 349 05 029) by Dennis J. Webb, Jr., attorney for the owner, seeks the following:

-    SE 17-01:  Special Exception per Chapter 27, Sec. 27-416 to reduce the required parking from 457 to 378.

-    ZBA 17-14:  Variance from Chapter 27, Sec. 27-73 to (A) reduce rear setback from 40 feet to 10 feet; and (B) Variance to reduce side setback from 20 feet to 10 feet.

Decision: The board voted to grant the variances with conditions (7-0).

 

ZBA 17-15:  Adam Schneider, owner of 1398 Wickenby Court, seeks a variance from Chapter 16, Section 16-78, to encroach the 75-foot stream buffer for construction of a retaining wall. The Tax Parcel ID is 18 363 02 033.

Decision: The board voted to grant the variance with conditions (7-0).
